Terms of Service

These Terms of Service ("Terms") are an agreement between you and Dashbd Inc. ("Dashbd", "we", "us", or "our"). They govern your use of dashbd.com, the Dashbd, Calendar by Dashbd, Countdown by Dashbd, Weather by Dashbd, Stocks by Dashbd, and Sticky Notes by Dashbd applications, and related pairing, local editing, user-media, feedback, weather, market-data, app-access, and support services (together, the "Services").

These Terms apply separately to every current Dashbd application: Dashbd, Calendar by Dashbd, Countdown by Dashbd, Weather by Dashbd, Stocks by Dashbd, and Sticky Notes by Dashbd. They apply on every supported platform and distribution channel and to each application's related website, pairing, editing, data, app-access, and support Services. Feature-specific terms apply only when you use a feature in an application that offers it.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you use the Services for an organization, you represent that you have authority to bind it. If you are not old enough to form a binding contract where you live, a parent or legal guardian must agree on your behalf.

1. The Services

The Services provide configurable TV and device dashboards, calendars, weather, market quotes and charts, sticky notes, clocks, countdowns, elapsed-time displays, home snapshots, feeds, and other informational widgets. Sticky Notes can expose a temporary editor to devices on the same local network and can store a private photo attachment for eligible notes. Features vary by application, device, operating system, country, distribution channel, configuration, and connected provider. Some features require Internet access, a supported Apple or Android device, a third-party account, or credentials or API keys that you supply.

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the applications for their intended purpose, subject to these Terms and the rules of the store or distribution channel through which you obtained them. No ownership rights are transferred to you.

2. Your responsibilities

You agree that you will:

• provide accurate information and keep pairing codes, QR links, local editing sessions, credentials, API keys, and connected accounts secure;
• use only accounts, calendars, notes, photos, feeds, images, APIs, and other content that you are authorized to access;
• comply with applicable laws and third-party terms; and
• review dashboard information before relying on it.

You must not:

• use the Services for unlawful, fraudulent, abusive, harassing, infringing, or harmful activity;
• probe, disrupt, overload, bypass, or interfere with the Services or their security, rate limits, or access controls;
• introduce malware or attempt unauthorized access to accounts, devices, data, or systems;
• reverse engineer or extract source code except to the extent that applicable law expressly permits it;
• scrape, resell, sublicense, or commercially exploit the Services or their data except with our written permission; or
• misrepresent your identity or affiliation or violate another person's privacy or intellectual-property rights.

3. Connected services and content

You choose whether to connect Google Calendar, Microsoft, iCloud CalDAV, iCalendar, Apple Home, Google Home, weather, market data, routing, feeds, images, APIs, and other third-party services. Those services are operated by their respective providers and are subject to their own terms and privacy policies. Dashbd is not responsible for their availability, accuracy, security, content, or changes.

You retain your rights in content you submit, such as a feature request, note, or photo. You grant Dashbd a worldwide, non-exclusive, royalty-free license to host, reproduce, display, format, and distribute that content only as reasonably necessary to operate, secure, and improve the Services. You understand that roadmap requests are public and may be edited or removed for moderation, security, legal, or operational reasons.

4. Purchases and subscriptions

Paid features may be offered as auto-renewing monthly or annual subscriptions, non-renewing lifetime purchases, free trials, or other products shown at the time of purchase. Products, prices, currencies, taxes, trials, features, and device or family eligibility may vary by app, store, country, and time. A purchase for one application does not unlock another application unless the offer expressly says so.

Purchases are processed by Apple, Google, or Amazon and managed with RevenueCat. The applicable store—not Dashbd—processes your payment method, charges, cancellation, and refund request. Store terms and mandatory consumer law govern those transactions. Dashbd does not receive your full payment-card details.

An auto-renewing subscription renews and is charged at the price and interval shown by the store unless you cancel it through that store before renewal. Cancelling normally stops future renewal and leaves access active until the end of the paid period. A free trial may convert to a paid subscription unless cancelled before the trial ends. A lifetime purchase provides access to the specified app features for the commercially supported life of that product; it is not a guarantee that the Services or every feature will remain available forever.

The store determines refund eligibility, subject to applicable law. To restore an eligible purchase, use the app's restore-purchases function while signed in to the same store account. We may change future prices or features; renewal price changes and required notices are handled under the applicable store rules and law.

Sticky Notes photos already attached while Pro was active remain readable after a downgrade. Uploading or replacing a photo requires a current Pro entitlement. Removing or replacing a photo deletes the prior object from active storage, subject to limited backup and legal retention.

5. Store-specific terms

Your use of an application is also subject to the rules of the store or channel that distributed it. For Apple-distributed applications, Apple's standard Licensed Application End User License Agreement applies where Apple makes it applicable. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the Services. Apple and its subsidiaries are third-party beneficiaries of the terms applicable to an Apple-distributed application and may enforce those terms as permitted by Apple's rules. Google Play and Amazon Appstore terms apply to applications obtained through those stores. If a mandatory store rule conflicts with these Terms, the mandatory store rule controls to the extent of that conflict.

6. Availability, updates, and changes

We may add, change, suspend, limit, or discontinue features or the Services. Updates may be required for continued use. Third-party APIs, data sources, operating systems, devices, and stores may change or stop supporting functionality without our control. We will provide notice of material changes when reasonably practicable, but we do not guarantee that any feature or integration will always be available.

You are responsible for maintaining compatible equipment, software, accounts, and Internet service. Data displayed by weather, calendar, home, routing, stock, crypto, forex, exchange-rate, earthquake, feed, or other widgets may be delayed, incomplete, unavailable, or inaccurate and is provided for general informational use, not as professional, emergency, investment, trading, financial, tax, medical, legal, safety, or navigation advice. A shorter app refresh interval does not make delayed exchange data real-time. You are responsible for confirming information through an appropriate source before acting on it.

Market data displayed by Stocks by Dashbd must not be used or relied on as a reference price or authoritative market value. It is provided solely for display and general informational purposes. Do not use this data to make any financial, investment, or trading decision. Quotes, charts, calculations, and displayed values may be delayed, incomplete, inaccurate, or materially different from the actual or executable market value.

7. Ownership

The Services, software, design, text, graphics, logos, and other materials supplied by Dashbd are owned by Dashbd or its licensors and protected by intellectual-property laws. All rights not expressly granted are reserved. Third-party names, trademarks, content, and data belong to their respective owners. If you send suggestions, you permit us to use them without restriction or compensation, but you are not required to provide them.

8. Privacy

Our Privacy Policy explains how the Services handle information, including app analytics, crash reports, app-access state, support diagnostics, connected calendars, pairing, feedback accounts, local note editing, private photo storage, and location-based features.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." DASHBD DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASHBD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR SERVICE, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING ANY NON-WAIVABLE CONSUMER RIGHTS.

11. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Dashbd and its directors, officers, employees, and affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, content you submit, or material breach of these Terms. This section does not apply where prohibited by consumer law.

12. Suspension and termination

You may stop using the Services at any time. We may restrict or suspend access when reasonably necessary to address a Terms violation, security risk, legal requirement, abuse, material breach, or threat to the Services or others. Where appropriate, we will provide notice and an opportunity to remedy the issue. Provisions that by their nature should survive will survive termination, including ownership, disclaimers, liability limits, and general terms.

13. Changes to these Terms

We may update these Terms as the Services or legal requirements change. We will post the revised Terms and update the date below. If a change is material, we will provide additional notice when reasonably required. Continued use after the effective date means you accept the revised Terms; if you do not agree, stop using the Services.

14. General

These Terms and the Privacy Policy are the entire agreement between you and Dashbd about the Services, except for applicable store terms or a separate written agreement. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, financing, reorganization, or sale. Mandatory laws of your place of residence, including consumer-protection rules, remain applicable.
